Conditions for lending and using archival materials from the Foundation for Arab Music Archiving & Research (AMAR)
Upon signature of this form, the requester acknowledges and accepts the terms and conditions listed below, while the requestee (AMAR) will, upon signature, perform a review of the request and will respond adequately the soonest possible, within its capacities, possibilities and limits. AMAR cannot be made liable for non-responsiveness or for not responding in accordance with above made request.
I acknowledge that the copy (-ies) of materials and images requested herein may be protected by particular copyrights. I acknowledge that it is my duty as the requester/user to clear copyrights if required and that copyright breaches or other legal implications deriving from the use of the requested works remain the sole legal responsibility of the requester/user, while such responsibility can by no means be passed on to the requestee/donor (AMAR). The Foundation may grant a copy of the work in question but does not grant any legal rights with respect to its commercial or non-commercial processing by the requestee/user.
Even if AMAR may rightfully claim its recordings to be at a high qualitative level, the requester/user has no claim concerning the level of quality of the recording. Recordings or other reproductions (e.g. pictures) are forwarded as they are available in the AMAR archive, the quality of which amongst others being determined by the quality of the original sound carrier.
I herewith explicitly free the requestee AMAR from any claims concerning the quality of the works in question.
I am aware that the above request form also determines the exclusive purpose of this request. AMAR will -if so- grant the usage of the forwarded materials to the aforementioned purpose only. The use of the material in question is therefore limited to the above-mentioned purpose and any use going beyond the described purpose may lead to legal pursuit and occur related costs. Any changes to above mentioned purpose must be agreed upon in a newly filed request form submitted by the requester/user.
I acknowledge that the use of above-mentioned material may be granted to the requester only and under no circumstances may be passed on to a third party unless specified in above request. Any changes to the Party appearing as requester/user within this document must lead to the filing of a new request form submitted by the requester.
I undertake to send two copies of any printed or audio product gratuitously to Amar Foundation to remain within its library.
I certify that I will cite AMAR Foundation as a reference in all related publications.
If AMAR grants your request, we will send you this form filled in, to sign by hand and return with a copy of your passport.
